On streaming platform, this film stands out as a rare mix of historical accuracy and thrilling storytelling.Also Read: Korean Dramas & Films Releasing In December: Made in Korea & More。未激活自动驾驶功能的自动驾驶汽车和驾驶仅具备辅助驾驶功能的汽车上道路行驶,按照非自动驾驶汽车的规定管理。  依据相关国标,草案所定义的自动驾驶汽车,对应L3有条件自动驾驶、L4高度自动驾驶两类技术形态。  本次提请审议的道交法修订草案,在国家法律层面确立全国通用的自动驾驶交通违法责任主体。  在此之前,国内自动驾驶的等级界定、技术标准、安全准入、适用场景均已通过国家标准、部委文件、地方立法完成全面、清晰的制度搭建。早在2021年发布的《汽车驾驶自动化分级》标准,在国内首次确立了完整的驾驶自动化等级划分体系,此后,国内围绕自动驾驶的制度体系持续补位完善。  不过,全国公共道路层面一直缺少上位法律作为执法依据,无法直接对普通公共道路上的自动驾驶车辆进行执法处置。这正是本次道交法修订草案所要解决的现实问题。  “这一制度突破,为L4级高度自动驾驶的商业化落地扫清了长期困扰行业的权责归属障碍;它不仅从法律上保障了L4系统在限定运行域内‘代替驾驶人持续执行全部动态驾驶任务’的合法性,更倒逼车企将技术冗余与安全验证做到极致,从而为我国高阶自动驾驶技术的持续创新与规模化应用提供了坚实且关键的法治保障。

三 |   产业日臻成熟,标准与地方试点先行  产业发展方面,国内L2级辅助驾驶已经实现大规模装车,比亚迪、理想、小鹏等多家车企的量产车型普遍搭载该类系统,市场渗透率持续走高。L3级有条件自动驾驶已经进入上路试点阶段,例如长安汽车深蓝SL03已取得L3自动驾驶专用号牌,在重庆指定快速路开展试点;北汽极狐阿尔法S(L3版)也在北京部分高速路段开展L3通行试点。  L4高度自动驾驶的示范运营则是已经开展多年:小马智行、萝卜快跑等已在国内多座城市落地Robotaxi服务;上汽旗下L4无人集卡已经在上海洋山港、宁波舟山港长期常态化作业多年。整体来看,自动驾驶的技术迭代、场景试点已经开展多年,产业基础已经成熟。  制度层面,2026年7月30日获批发布、计划2027年7月1日正式实施的强制性国家标准GB 44721-2026《智能网联汽车自动驾驶系统安全要求》,进一步细化L3、L4级自动驾驶的安全准入底线、技术运行规则和企业主体要求。

四 |   依据GB 44721-2026定义,L3级为有条件自动驾驶,车辆可在限定运行条件内由系统完成全部动态驾驶任务,但需要车内驾乘人员作为后备接管主体,系统发出接管请求后,驾乘人员需在规定周期内完成接管操作,车辆最小风险策略为停靠至路边安全区域。L4级为高度自动驾驶,限定运行条件内可由系统独立完成全部驾驶操作,无需依赖车内人员后备接管,突发工况下可自主将车辆转移至安全区域静置避险。

五 |   除等级定义外,该强制国标还明确企业需建立自动驾驶车辆全生命周期安全档案,覆盖车型设计、生产制造、OTA升级、售后运维全流程,留存全部试验与运行记录;同时要求车企清晰公示自动驾驶功能边界、适用场景与使用限制,规范产品宣传口径,杜绝功能混淆表述。  在地方试点层面,深圳、上海、北京、武汉等多地已出台智能网联汽车地方管理条例,对本地自动驾驶示范运营、道路测试、轻微事故处置作出细化规定。例如上海施行的《上海市智能网联汽车测试与示范实施办法》,对本地测试、示范运营、商业化试点的条件与责任作出地方层面制度安排。

六 |   整体来看,目前国内自动驾驶产业的技术标准、产品准入、分级定义、地方试点规则均已较为完备,部分试点场景下,其实也已有对应的责任处置规则。但原有责任相关安排局限于测试示范场景,缺少能够覆盖普通公共道路的交通违法责任划分依据。  本次道交法修订草案,正是把试点阶段积累的权责逻辑上升到国家法律层面,补齐这最后一道缺口。  业内人士:利好消费者,或将对车险带来颠覆变革  针对本次草案修订内容,乘联分会秘书长崔东树指出,本次道路交通安全法修订从以往零散的政策补丁,升级为专项法律章节规范,打通了L3及以上高阶自动驾驶商业化落地的上位法障碍。

七 |   在他看来,一方面,这将为消费者购车用车提供更好的决策依据,“此前工信部发布的两项强制性国标已经明确:L2模式下驾驶员全责;L3自动驾驶激活状态下,车企对系统安全承担主体责任。

八 | 此次道交法修订将这一归责逻辑从行业标准上升到国家法律层面,为交通事故认定、消费纠纷处理提供了法规依据。”  另一方面,这也对车企提出了更高要求:法规落地后,车企再也不能玩文字游戏了。

九 | 安全达标才能上市,责任明确才能卖车。这将彻底终结以“智驾”为营销噱头却逃避责任的行为模式。  “这对我们消费者是好事——买到的是真家伙,不是半成品。”崔东树强调说。  有智驾业内人士在接受澎湃新闻记者采访时直言,此次道交法修订带来的变化,对整车企业的实际影响或许并不会太大,因为此前国标早已详细规范了企业的“可为与不可为”,企业内部已在按照国标推进相关研发工作。真正受到巨大影响的或是车险行业。  该名业内人士指出,随着责任主体向车企转移,市场需要诞生专门匹配自动驾驶激活场景的产品责任险,传统以驾驶员为核心的车险定价逻辑需要重构,或将给整个车险行业带来结构性变化。不过他也提到,相关保险落地,还需后续配套细则、精算模型及风险数据的积累,“是个长期磨合的过程,不排除车企在这期间要自行兜底一段时间”。  东财图解·加点干货(文章来源:澎湃新闻)。
